 NPI
has established basic standards for the registration of
contracts through laws and legal acts, which regulate
the entrepreneurial system in general.
Technology transfer and trademark or patent
licensing should be formalized through contracts duly
registered with INPI in order to allow the necessary effects
in relation to third parties. This registration allows
for lawful operations to be carried out, such as the remittance
of dividends abroad and the corresponding fiscal deduction
for the companies involved in the process.
The main types of contracts that can be registered are:
-
Technical and Scientific Assistance
Contract - related to the acquisition of technical
information, planning or programming, studies or projects
in general for the rendering or execution of special
services.
-
Patent Exploitation (EP) -
for the licensing of a patent request or a patent
already granted.
-
Use of a Trademark - for the
licensing of a trademark registration request or registration
already granted.
-
Technology Transfer - for the
acquisition of non-patentable techniques and/or know-how
for the production of services, industrial or commercial
products.
-
Franchising - for the concession
of a trademark, with the rendering of additional services
or technical assistance, with the transfer of total
or partial information related to the business.
